Kathy Griffin,from “My Life On The D-List,”has just filed a lawsuit against the owners of KathyGriffin.com putting them on the D(efendant) List. She alleges the site is using her name and image without authorization. On September 16, she filed a lawsuit in Los Angeles Superior Court and is seeking at least 100,000 in statutory damages under the Anti-Cyberquatting Act and for misappropriating her right of publicity, according to the Hollywood Reporter.
“The harm to [Griffin] is direct and palpable,” the lawsuit reads, adding the site was purposely designed to make viewers “confused into believing that [Griffin] authorizes, sponsors or somehow is affiliated with the,website.”
Star attorney, Marty Singer filed the suit on Kathy Griffin’s behalf. It states that the owners of the site, which was registered to Trafficz.com via a privacy-protection agency, have been trading on the reality star’s “good reputation and recognizable name for a commercial purpose,and reaping the uncompensated benefit from the unauthorized use of [Griffin's] name and identity.”
The site previously contained commercial advertising content and click-through advertising, but now consists of just two lines, “Are you looking for Kathy’s official website? It’s located at kathygriffin.net.” This update still does not make Kathy happy nor does the fact that the site offered to sell the domain name toher back in July of this year for $3,500.
Kathy has had an exceptional year despite the unauthorized website suit. She took home her second Emmy for the Bravo reality show My Life on the D-List earlier this month, and the show has been picked up for a fifth season.
