Jon and Kate Gosselin, stars ofÂ Jon & Kate Plus 8 and divorced parents of eight children, are returning to court for a custody battle. Calling Kate an “absentee mother” for her time-consuming gig onÂ ABC‘sÂ Dancing With the Stars, Jon filed papers with a Pennsylvania judge on Wednesday for primary custody of the couple’s eight children. In addition to the custody battle, Jon also asked for a review of the current children support order. As it currently stands, Jon is required to pay Kate $20,000 per month in child support.
In the lawsuit, Jon alleges that Kate “abuses” their custody agreement terms and hasn’t documented the children’s expenses as required. The custody battle comes in response to Kate’s new job as a celebrity competitor onÂ ABC‘sÂ Dancing With the Stars, which keeps her away from the children much of the time.Â ”He wants equal say with custody, equal time, but if the circumstances remain as they are, with Kate being rarely home, Jon wants primary custody of the children,” Jon’s lawyer, Anthony List, says.Â ”I don’t know how, physically, she can spend any time with them because she seems to be taping some show 3,000 miles away.”
Kate fires back to the claims of her being an absentee mom, sayingÂ ”I am not willing to comment in public on the custody discussions regarding my children. What I will say is this: I am and always will be a mother first, but as a single working mom, I will do everything necessary to provide for my kids despite the opinions of others.”
Meanwhile, Kate’s lawyer, Mark Momjian, called the claims “pathetic” and thinks the custody battle is nothing more than an attempt for Jon to gain fame.Â ”He’s never questioned her ability to provide for their children. He’s out of the limelight, while 23 million people are watching Kate on Dancing With the Stars,” Momjian says.Â ”Do I think his motivation is the children’s best interest? Squarely no.”
