Sometimes what looks like a tax break can become a tax nightmare and Katie Holmes may make that nightmare a reality for Tom Cruise. So why did the “So You Think You Can Dance” star file for divorce in New York City?
TMZ is reporting that Katie Holmes filed for divorce from Tom Cruise in New York City because it will be easier for her to maintain custody of the couple’s child, Suri. However, there are more monetary issues at stake.
According to sources, Tom tries to avoid strong ties to New York because the tax rates are exorbitant. He absolutely did not want the appearance of the couple living in the city.
Legal documents show that Tom deeded their New York City apartment over to Katie Holmes last August specifically for tax purposes. Katie is now using the apartment to establish residency in New York City. This could really create a tax mess for the mega-movie star who will fight Katie to establish California as the divorce home base.
Rumors are circulating that Katie Holmes is primarily interested in sole custody of Suri so that she is not raised in the Church of Scientology. New York City is a much more likely location for Katie to win that custody battle. New York family law judges typically do not grant joint custody to parents who are at odds because the children will suffer psychologically from the fighting, stress and conflict.
Katie filed for divorce from Tom on Thursday in a move that surprised the movie star. The couple was seen wearing their wedding rings earlier in the week.
