Trouble seems to follow Punk’d star, Lindsay Lohan everywhere she goes. In her latest snafu, she tussles with guest, Christian LaBella while trying to delete photos from his cellphone after a night of clubbing and living it up. And then she cries assault. What's up with that?
LaBella and Lohan fought over LaBella’s cellphone, which resulted in an alleged assault on Lohan. Subsequently, LaBella was arrested for misdemeanor assault but was later released and charges dropped when Lohan refused medical treatment and police determined no one had been injured. The question is did she have the right to be upset and delete the photos?
According to the Los Angeles Times, the answer could very well be yes. Even though Lindsay Lohan met Christian LaBella at a bar and took him back to her hotel room at four in the morning, he didn’t have the right to secretly photograph her “if” she had an expectation of privacy at the time.
Did Lindsay know she was being photographed? According to Carolyn E. Wright of photoattorney.com, if she was aware the photos were being taken, then she cannot claim to have had an expectation of privacy and LaBella was not in the wrong and could even sell the photos for profit. Lucky for LaBella, Lohan will have to prove her claim in a court of law.
