Bristol Palin Suit Tossed Out By Judge, Heckler Ordered To Pay Legal Fees

November 04, 2012 07:40 AM by Lisa Princ

Last year, Bristol Palin was heckled at a Hollywood restaurant and bar, by a man who then went on to file a defamation lawsuit against the Dancing with the Stars alum, even though he was caught bashing Bristol, and her mom, Sarah Palin. But now, Palin’s attorney announced that the lawsuit has since been tossed out by the judge!

Karma, anyone? Last September, Bristol Palin made headlines when she was heckled at a bar and restaurant in West Hollywood, during the filming of her show, Life’s A Tripp. Stephen Hanks, the bar heckler, made a crude reference to Bristol about her former relationship with Levi Johnston, and went on to call her mom, Sarah Palin, a “whore.”

Hanks then went on to file a defamation lawsuit against the star, claiming that Bristol Palin called him “gay,” and ruined his reputation when she gave an interview blaming him as the reason she was going back to Alaska. Hanks also included A&E (the parent company of Lifetime) in the suit, as he claimed he never signed any waivers to appear on the show.

Bristol Palin’s attorney announced recently that a judge has tossed out the suit. According to TMZ, the judge sided with Bristol and A&E on every count, claiming the show was protected by the First Amendment, and also that Hanks did not have his privacy violated because no unknown facts about him were revealed. The judge has also ordered Hanks to pay the Palin’s legal fees.

What do you think of Bristol Palin’s heckler suit getting tossed out? Was justice served? We know you have an opinion, and we want to hear from you! Comment and share your thoughts with us below!

Come on!! I can agree with tossing out the law suit, but making this guy pay HER legal fee’s. That I cannot agree with. Just ridiculous I say!!

If Palin really did go back to Alaska because of what Hanks said, we owe him a debt of gratituted. Maybe he should put a web site up to collect donations for the money that he has to pay – it would be a small price if it means that we never have to see this little wanna-be again.

What an idiot. I’m so tired of stupid lawsuits – celebrity or otherwise. People need to stop trying to get something for nothing and be accountable for their own actions or inaction, as the case may be. This guy…well, there are really no words. He heckles her, then sues for defamation? How did he think this was a good plan?

Just because a judge tossed out the lawsuit doesn’t mean the First Amendment protects public slander, or that there wasn’t any legal grounds for Stephen Hanks to file the suit. Defamation laws change when you go from one state to another. You can check out the details by looking at your state’s decree of limitations in relation to personal injury law.

Unfortunatly, we’re not going to know the details of what actually happened because the judge threw the case out. We won’t know who actually started the fight or what was really said. All we have are two sides to this story and no truth.

It’s a shame that Gov. Palin and her daughter are attacked simply because they stand up for love, goodness, protetction of the unborn and their love for America. The Liberal LEFT should be ashamed but then again they would have to know what decency is and I’m afraid they must have missed that in their upbrining. The Palins are what America is all about, they don’t claim they are perfect but some people are just pure JEALOUS of them and what they stand for!

I believe it was Shakespeare who once said, “The world is a stage.” Today, it seems that the world has become one big reality show. How this YAHOO ever thought he could sue Bristol Palin and get monetary compensation is beyond my comprehension! May I also add that Levi Johnson has proven himself to be a loser and societal leech, but we only have ourselves to blame as a society for giving him attention.

It’s time for the frivolous lawsuits to stop and the person initiating the lawsuit to pay for it! It doesn’t matter against whom the suit was posted, frivolous lawsuits are a waste of court time.

  15. Chris Cross Says:

Bristol has TWO illegitimate children; Sarah did not give birth to Trig (the little boy with Down syndrome). Sarah and Todd adopted him from Bristol because Bristol didn’t think she could handle a kid with special needs. (The second one was evidently good enough to keep.) Bristol missed 5 months of school with “mono” during the time Trig was in utero. Sarah had a flat tummy until 2 months before she “gave birth.” Yeah, right…a woman in her 40′s on at least her 5th pregnancy doesn’t show? Uh huh. The day before she announced “her” pregnancy, Sarah was interviewed by Newsweek (there are videos of this). She was wearing skin-tight boots (no swollen legs?), sat cross-legged, and bent forward at the waist. Seriously, a woman 7 months pregnant can do this? Ask any woman who has given birth. Yes, and I’ll sell you some swampland in Florida. Also, there are photos of Sarah when she was supposedly 7 months pregnant; she is clearly wearing a square cushion under her clothes.

  16. professormarvel Says:
    November 4th, 2012 at 9:25 am

I do not care for the Palins; any of them, but in this case, the heckler was way out of line and justice was served.

  17. Truther Says:
    November 4th, 2012 at 9:26 am

Sarah Palin won’t confess that her youngest “child” is not her biological son; it is probably her oldest daughter Bristol’s child. There are photos of her “pregnant” where you can clearly see that she is wearing a square pillow under her clothing. Plus, Bristol missed 5 months of school with “mono” before and around the time that Trig appeared. And Sarah didn’t show until she declared that she was 6 months pregnant…with baby #5? Yeah, right. Literally the day before she announced her “pregnancy” with Trig, she was interviewed by Newsweek, sitting bent at the waist, cross-legged, wearing tight boots. Have you ever met a woman 6 months pregnant who could sit bent over at the waist and cross her legs? And while wearing skin-tight boots (what, no water-weight gain?)? No? And you never will.

  24. Florence Bradley Says:
    November 4th, 2012 at 10:13 am

Yes, I agree with the judge. The man was unjustified to file the law suit. She could have sued him for harrassment or verbal assault after the way he acted. But the Palin’s have too much class to do that.

  28. Marylka Says:

I’m glad he was ordered to pay the legal fees too. This country has too many lazy, greedy fools looking for lawsuits – not just the rich and vulnerable, but lazy governments paying out taxpayers’ money, and insurance companies who pay because that’s easier and cheaper than fighting.

  29. Josey Says:
    November 4th, 2012 at 10:39 am

She could file a counter suit and take away every last penny of the guy. This was an outrage and for the guy to use his “gayness” as an excuse for a frivolous lawsuit undermine gay folks who actually are attacked for being gay is an outrage.

The reality is this: Sexual orientation aside, there are scummy people everywhere and this guy is one of them.

awesome. this guy is a money grubbing a-hole. regardless of your beliefs it is NEVER correct to call a lady a whore. Whether you like or hate the Palins they have never acted with any form of negative or slutty behavior. Judge them with the same criteria that you judged (or didn’t judge) Bill Clinton. This guy is either a money grubber, a jealous gay man that is a whiny puss, or an extreme liberal with an agenda. Either way he is worthless. It would have been a different outcome if I was there while he was bashing either lady in public calling them whores. And the same goes for rush Limbau’s idiotic comments about the young lady that testified bout health insurance. He is an idiot and only damages the conservative movement and republican party (he is a mean A-Hole) and reminds me of an angry recovering alcoholic.

  49. Dave Woodling Says:

Finally a judge got it right. The heckler should have been punched out by any real men in attendance. And the rediculous lawsuit was just looking for money he didn’t have to earn. Lots of that going on. Good for Bristol.

  50. Ben Begonia Says:
    November 4th, 2012 at 12:07 pm

Stupid judges are the reason why this country is going to hell. They protect people who knowingly and intentionally causes harm to other people. Judges should be elected so that when they become unsuitable to carry out their responsibilities, we have the option of voting them out.

  51. Lance Voorhees Says:
    November 4th, 2012 at 12:08 pm

Based on the information given, the suit was rightfully thrown out. Whether the guy was gay or not shouldn’t even be a concern, courts need not be concerned with such trivial matters, as much as they may hurt someone emotionally.

Can you imagine a lawsuit against anyone calling someone a son of a bitch? “My mother wasn’t a dog and she was never bitchy, therefore I am suing you.” Give me a break!

  52. Charles Sansing Says:
    November 4th, 2012 at 12:12 pm

  53. Maggie Says:

  54. Joe Says:
    November 4th, 2012 at 12:23 pm

The guy had a mouth on him and asked for every charge against him. Bristol is a very young woman and did not deserve his heckling because of her Mom’s celebrity. Possibly the judge’s ruling will make Hanks think about controlling his silly tonuge in the future.

  55. Mike0oSS Says:
    November 4th, 2012 at 12:25 pm

Well, the suit gets tossed, but the heckler gets to pay the court fees. When a homo gets in your face, you have no rights, other than to ask them out…LOL

  56. John Says:
    November 4th, 2012 at 12:29 pm

I think it is fantastic that a judge has thrown out such a frivolous case filed by a person looking to cash in on a famous person he verbally attacked. I think the judge should impose some other penalty also. Now if we could find more judges like this our court systems might have more time for serious cases.

Gotta admit ,her mom picked a pretty good way to make millions .She got paid well to travel all around the world to talk her head off about politics and really never had any intention of even sliding her foot in the door…god bless she made money and laughed all the way to the bank..smart woman

  59. William Pantano Says:
    November 4th, 2012 at 12:43 pm

Of course justice was served. You don’t interupt a filming to degrade someone, then file a lawsuit because they retaliate against your attack. Mr. Hanks was the instigater, and should have been forced to pay legal fees, and production costs to A&E for interupting the filming.

  60. jim Says:
    November 4th, 2012 at 12:46 pm

I’m glad the lawsuit was tossed. I saw the episode where Sara Palin was heckled. The heckler started his heckling when Sara Palin walked in. What does he think he can heckel her and not be heckeled back? Don’t pick on anyone for any reason if you are not ready to be picked on by them! I’m glad he was made to pay her court costs. He started it, and it ended with him losing his case and having to pay Ms. Palin for the cost that he made her incur.

  61. Ken Hissner Says:

I’m no fan of any of the Palin’s, but its about time that stupid frivilous lawsuits were thrown out and those filing are held accountable. I only wish the plaintiffs attorney was held liable as well for even accepting the stupid suit.

Now, The Palin’s heads will get even bigger. They think they are above the common people already. You can’t make up lies about people and publish them. Nor can you harass people in public. All parties should be sent to bed without supper.

Good for Bristol and her family as well! This piece of trash accosted her not the other way around and her entire family, including the gifted child Trigg has been vilified and excoriated for no other reason that they are a family with traditional AMERICAN values with a belief in American Exceptionalism and constitutuional government; not the rampant socialist violation of all things constitutionl currently going on and which has been ongoing for the last four years! HOPEFULLY, WE WILL REMEMDY THAT IN A FEW DAYS AND PERHAPS PROVIDE SOME MUCH EARNED PEACE AND DIGNITY TO A GOVERNMENT TOTALLY DEVOID OF EITHER UNDER THE PRESENT INEPT AND UNQUALIFIED EXCUSE FOR LEADERSHIP!

I don’t think Bristol Palin danced well at all. In fact, I think she was the worst dancer in the bunch, clumsy and awkward. I guess dancers aren’t judged on their abilities but who they are connected with. I don’t watch Dancing With the Stars anymore.

the heckler lived in my building. He has been broke for years and was looking for a hand out. He was foreclosed on before this incident even happened. The sheriff FINALLY threw him out. His dogs were even more annoying than he was, if you can imagine THAT

  101. Debbie Says:

I think all lawsuits should end with the loser paying the others attorney fees. This is how it is handled in many other countries and it helps keep stupid lawsuits like this from bogging down the legal system. And with demand lowered attorney fees also go down.

Its about time the courts did something right. This guy was just looking for his fifteen minutes of fame. He got it, now its time to pay up for his inappropriate behavior.

Love the Palins or not, I am sick to death of people bashing this young lady because they either don’t like her mothers politics or they seem to think that because she was a teenage mother that she is bad. Bull crap, tons of teenagers make mistakes when it comes to sex, doesn’t mean that they’re whores or bad influences. She kept her baby and is doing the best she can by him, how much better would these hecklers be able to do with all the constant hate flowing at them. Makes me sick how society is treating her.

The guy entered in front of TV cameras he knew was there, in an environment that most probably had security cameras filming at all times, and he doesn’t want to be seen publicly acting as he did publicly.

After he pays up, he needs a mental evaluation to ensure he is safe to own weapons.

Hecklers hide behind the First Amendment and harass others. If you start it don’t get mad when someone else gets the better of you in a war of words. If Hanks was trolling then how can Bristol ruined his reputation? A heckler’s reputation is already ruined from the start. If you file and loose a stupid law suit the judge should ordered you to pay all the legal fees.

Stephen Hanks, the animal that insulted the Palin
family to the point of disgust, got what he richly deserved. He should pay for the nuisance suit he filed.
Perhaps this will teach a lesson to the bully boys around the gay bars in America. Insult someone and try to gain from it and you just might have to pay the tab when a reasonable judge drops the hammer on you.
Good for Bristol. Shame on Stephen Hanks.
I watched it. Shockingly rude fella. Pay up,Mary.

Thank GOD he lost on all counts especially having to pay all her legal fees. Hope that teaches him a lesson unless he really is STUPID then foget it, he won’t , he’s incapable, because HE”S STUPID!!!!!
