Lindsay Lohan Says Cops Were Mean, Wants Case Dismissed

February 26, 2013 08:00 AM by Megan Wilson

Lindsay Lohan and her lawyer are trying their hardest to get out of their court date in regards to her accident last June.  The court is asserting that Lindsay fibbed to the police after the incident, and Lindsay’s attorney, Mark Heller, is claiming that the cops were downright RUDE to the Punk’d star, and didn’t follow the law when questioning her!  Keep reading for the details!

Lindsay Lohan has been accused of lying to cops about where she was seated in her vehicle on the day her Porsche took a hunk out of the back of an 18-wheeler.  Mark Heller, her newest lawyer, is saying that the cops did not follow the law when questioning Lindsay; he asserts that they all-out bullied her!  She supposedly wasn’t read her Miranda Rights before being asked whether she was driving her vehicle at the time of the accident.  And here’s where things get muddy.  Lindsay is claiming that even though she asked for a lawyer during her questioning, she was not allowed to have one present.  Lindsay even claims that the cops were “mean” to her!  Law enforcement officials, however, are saying that Lindsay’s entertainment lawyer was there THE ENTIRE TIME.

Heller also stated that Lindsay was given a DUI test at the hospital-which she passed.

Whichever story is true, Mark Heller is trying his hardest to keep the case out of court.  He’s filed what’s known as a “Bill of Particulars”, along with a request to suppress evidence, continue the case, and have the charges completely dismissed.

Do you think this case will go to court?  Let us know in the comments!

This is unreal, anyone else would be serving some real time for everything this girl has pulled. These judges love stars and are part of this system that idolizes rich porn stars over hard working citizens who pay taxes and obey the law.

You come across as an excitable 13 year old girl when you use exclamation points after every sentence. Real journalists don’t use any exclamation points when the write. If you want to convey excitement, do it with your words. You will appear much more professional in print.

This case will not go to court. The attorney is correct in filing that bill. This will show the entire report and will prove it to be incomplete by the filing officers. This case should easily be dismissed for lack of evidence. It seems like the cops were interrogating her, which is grounds for dismissal based the the fact that her rights were not addressed, such as her lawyer being present before questioning and invalidation of miranda rights. It all just seems like hearsay or what you think happened. You must have evidence and if it is found that the report was done incorrectly, it will be removed from the case and that issue will be dismissed.
By any means, we are guilty of many things in life and sure we all get away with certain things. I just believe that the public/ paparazzi makes everyone in the acting industry seem either good or bad. It’s the critics that put everything out there so the public can decide whether to hate or not to hate. I will just tell you my side as everyone else will.
I believe that Lindsay Lohan is not guilty. I just hope everyone can move on and let her live her life. I am glad she is making the tabloids, but people should be able to see the good in her. I know there is good. She may seem bad, but when you are as scrutinized as her, it’s hard not to mess up. I couldn’t even imagine being followed around 24-7, I would go nuts. I commend everything you are Lindsay. Good luck. Follow Me @localseacret
