Teresa And Joe Giudice Ask For Separate Trials In Their Fraud Case

January 23, 2014 10:00 AM by Suzy Kerr

Who would’ve thought Joe Giudice was so chivalrous? In a possible game-changing move in the Giudice’s court battle, the Real Housewives of New Jersey star has requested separate trials for himself and his wife Teresa, stating that Teresa had no involvement in the criminal activity they’ve been charged with and didn’t even know it was happening.

People obtained copies of court documents Joe Giudice filed on Jan. 15, where he more or less is assuming 100 percent responsibility in the 41 counts of fraud he and his wife have been charged with. In the legal paperwork, Joe says that Teresa was never involved and he’s willing to testify to her innocence – but only if they’re granted separate trials. The documents, filed by Joe’s attorney, read: “Should the trials be severed, Mr. Giudice has affirmed his willingness to testify as to Teresa’s involvement in the alleged criminal activity. He would be unable to do so in a joint trial wherein his Fifth Amendment rights are invoked.”

Other highlights from the filing include that the Real Housewives of New Jersey star, if granted a separate trial from his wife, will testify that Teresa’s name was signed on numerous legal documents and loan applications without her knowledge, that she had no knowledge of businesses owned in her name, and that she was unaware of real estate purchased in her name. Additionally, Joe is also willing to take a few other people down with him to protect his wife, including his business partner Joe Mastropole and his lawyer Fred Roughgarden, both of whom allegedly signed Teresa’s name without her consent.

There’s no word yet on whether or not the judge will grant Joe’s request for separate trials, and right now the two aren’t scheduled to be back in court until April 9. Both face up to 50 years in federal prison if convicted.
