It’s a small victory, but it’s a victory nonetheless. Kim, Kourtney and Khloe Kardashian – along with their mom Kris Jenner – are currently embroiled in a legal battle against their ex-stepmother Ellen Kardashian, but the Keeping Up with the Kardashians stars secured a small win in the court battle yesterday when a judge dismissed part of the case.
A Los Angeles Superior Court judge ruled yesterday to drop Ellen Kardashian’s claims that the Kardashian girls intentionally inflicted emotional distress upon her and committed a conspiracy to defame her.While the ruling is only preliminary at this point, it’s still a victory for the Keeping Up with the Kardashians star who are still facing other defamation and libel claims from their former stepmother.
Ellen, who married the girls’ father, famous attorney Robert Kardashian, two months before he died in 2003, is suing Kim, Kourtney, and Khloe Kardashian, as well as Kris Jenner, for a number of civil offenses, including defamation, harassment and public disclosure of private matters. Brother Robert Kardashian was also named in the case, but a judge has since dismissed him.The Superior Court judge also ruled that he would allow Ellen’s primary allegations of libel and defamation to move forward, and that he would provide a written ruling in the coming days.
In the meantime, Kris and her famous daughters can plan how to defend themselves against Ellen, who has insisted that she can prove her late husband’s ex-wife and daughters maliciously slandered her after Robert’s death. “Plaintiff can demonstrate a substantial likelihood that Defendants made their statements with actual malice in regards to the truth,” read the court documents.
And while Kris and Kardashian girls are busy plotting their rebuttals, Ellen can plan how she’s going to fight the reality stars’ countersuit. In the lawsuit filed by Kris and her children, they allege that Ellen sold their personal family photos and writings to the media last year, and they’re seeking $500,000 in damages.
